Letter to the New South Wales Attorney General on the Paternity plea of Robert William Hughes

Sir, we have the honour to request your advice upon the following case. One Robert Hughes a sawyer has laid a complaint before us against one Thomas GAMESTER a sawyer and one Mary Patrick, the former for forcibly taking from him his natural son named Edward John Hughes an infant under two years of age and aiding and abetting the latter [the mother of the said child] in detaining and maintaining possession of the said infant and praying that it might be restores to him.

The parties appeared upon a summons this day to answer the charge:- being desirous of settling the matter amicably we recommended the mother Mary Patrick to give up the child to its father, Robert Hughes, but she declined doing so and expressed the willingness to support it.- By the 21 seciton [sic] 9 Geo 4. Cap31 the forcibly taking and detaining a child, under ten years of age, from its parents is declared a felony [the father of any illegitimate child being made an exception and not liable to prosecution even in taking such child from the possession of its mother &c. - In the case the mother having expressed her determination to keep possession of the child we feel at a loss how to act;- by advising the father to take the child, a breach of the peace would in all likelihood take place, and we are not aware that we possess any power of assisting the father in obtaining forcible possession of the infant in question.

It appears that Robert Hughes and Mary Patrick have lived together in this district for three of [sic] four years as man and wife and in January 1847 had two children Christened at the Church by the Episcopal Clergyman as appears by the book produced at the police office, purporting to be the register of the parish - about a fortnight ago Mary Patrick left Hughes taking the children with her and on the following Sunday the names of Thomas Gamester and Mary Patrick were called in church and they are about to be married. We have adjourned the case in order that we might have the benefit of your advice in the matter which we beg you will favor us with.
